Who Still Has Time To File

Not every taxpayer was bound by the July 31 deadline. Those earning income from a business or profession that requires an audit continue to have more time, with their ITR filing deadline set for August 31, 2026, subject to applicable provisions.

  • July 31, 2026: Applicable to most salaried individuals and taxpayers not required to have their accounts audited.
  • August 31, 2026: Applicable to specified businesses and professionals covered under revised due date provisions.

What Are Your Options After Missing The Deadline

Taxpayers who missed the original due date generally have two routes available.

The second is to file a belated ITR after paying the applicable late filing fee. The deadline for submitting a belated return is December 31, 2026.

The late filing fee depends on total income, at Rs 1,000 if total income does not exceed Rs 5 lakh, and Rs 5,000 if it exceeds Rs 5 lakh.

The Financial Cost Of Filing Late

Chartered Accountant Abhishek Soni, co-founder of Tax2Win, said that filing a belated return can carry several financial and tax implications:

  • Late filing fee: A penalty of up to Rs 5,000 may be levied under Section 234F, capped at Rs 1,000 if total income does not exceed Rs 5 lakh.
  • Interest on unpaid tax: Interest under Sections 234A, 234B, and 234C is charged at 1 percent per month, or part of a month, on the outstanding tax liability from the original due date until the tax is paid.
  • Loss of carry-forward benefits: Taxpayers may lose the ability to carry forward certain losses, such as business and capital losses, to future assessment years, subject to specified exceptions.
  • Delay in tax refunds: Those eligible for a refund may face longer processing times if filing after the due date.
  • Higher compliance risk: Continued non-compliance or willful failure to file may invite notices from the Income Tax Department and, in serious cases, legal action.

Why Filing Soon Still Matters

Although the original filing deadline has passed, delaying further can increase both the financial burden and compliance risk. Filing a belated return before December 31, 2026, paying any applicable late fee and taxes, and ensuring accurate information can help taxpayers avoid additional complications.

Those who already filed on time but later spot an error can still correct it by filing a revised return before March 31, 2027. Taxpayers uncertain about their eligibility or filing requirements are advised to review the applicable rules carefully or seek professional guidance to ensure compliance.
