Supreme Court Dismisses POCSO Charges Against School Teacher Over Corporal Punishment Incident
The Supreme Court quashed a POCSO case against a school teacher, ruling that corporal punishment like hitting students without s*xual intent does not constitute s*xual assault. The Supreme Court has quashed a case under the Protection of Children from S*xual Offences (POCSO) Act, 2012, against a school teacher who was accused of hitting minor girl students on their backs and waists during class.
Supreme Court Ruling and Observations
In an order passed on September 8, a bench of Justices Ujjal Bhuyan and Atul S Chandurkar held that the students’ statements did not indicate that the teacher had touched them with s*xual intent, which is a mandatory requirement to constitute s*xual assault under the POCSO Act, reports Bar and Bench. While acknowledging that the teacher's use of corporal punishment was inappropriate and that he lacked sensitivity when dealing with female students, the bench emphasised that such behaviour alone does not justify prosecution for aggravated s*xual assault under stringent legislation. The Court further underscored the severe, irreversible professional and personal damage that an unfounded POCSO trial can inflict on a teacher's reputation, noting that an eventual acquittal fails to fully repair such profound harm.
"For a teacher serving in a girls’ school or a school which is co-educational, such an allegation or trial virtually amounts to condemning him, not only for his entire service career as a teacher but for his life as well. He has a family also. Therefore, to accuse a teacher of committing s*xual assault on girl students, would be like a death knell for such a teacher. Ultimate acquittal would not redeem the appellant as it would be wholly inadequate to undo all the pervasive damage already suffered by him due to the severity of the criminal trial under the POCSO Act. While the appellant certainly needs to sensitise himself while dealing with students of tender age, particularly girl students, it cannot be a ground for prosecuting him under the stringent provisions of the POCSO Act,” the Court stated.
Case Background and Legal Proceedings
The legal proceedings originated from allegations against Bhaskar Paul, a geography teacher at a school in Alipurduar, West Bengal. An inquiry conducted by the District Child Protection Unit recorded claims that the teacher had touched students inappropriately during school hours, leading the Samuktala Police Station to file an FIR under Section 10 of the POCSO Act. During statements before a magistrate, the students clarified that the physical contact occurred when they were struck for failing to learn lessons, pointing to disciplinary corporal punishment rather than s*xual misconduct. Reviewing the legal definitions, the Supreme Court reiterated that under Section 7 and Section 9(f) of the POCSO Act, physical contact by a person in authority constitutes an offence only when driven by s*xual intent. Finding no evidence of such intent and noting procedural delays in registration, the bench set aside the High Court's order and quashed all pending proceedings against the appellant.
