A US district judge has refused to block Meta from proceeding with layoffs scheduled for July 22, despite allegations from 26 employees that the company used AI-powered tools to target workers with disabilities or those who had taken medical leave. The ruling, delivered by US District Judge William Orrick in Oakland, California, determined that the plaintiffs failed to demonstrate that the loss of their jobs constituted the "irreparable harm" necessary to warrant an emergency injunction.

As per a report by Reuters, the legal challenge is the first of its kind in the United States to target a major corporation over the alleged use of artificial intelligence in selecting staff for redundancy. They allege that Meta utilised internal AI systems, including a large language model known as "Metamate" and productivity-tracking tools, to score and rank staff for termination. According to the legal filing, these systems tracked communications, documents, and keystrokes but failed to account for legally protected leave, resulting in lower productivity scores for those who took time off for medical or family reasons.

Meta, which announced in May that it would cut approximately 8,000 jobs as part of a wider effort to prioritise AI investment, has denied any wrongdoing. The company maintains that all layoff decisions were ultimately made by human managers rather than automated systems. Meta's legal counsel also argued that the potential damages cited by the plaintiffs, such as the loss of employer-subsidised insurance, are standard issues that could be addressed through private arbitration at a later date.

Implications of the Legal Battle

The case highlights broader concerns regarding the intersection of artificial intelligence and employment law.
