The Supreme Court is set to examine whether provisions of the Right of Children to Free and Compulsory Education (RTE) Act, 2009, can be applied to minority educational institutions, including madrasas, Vedic pathshalas and institutions primarily imparting religious instruction. A Bench of Justices Dipankar Datta and Sheel Nagu has directed that a public interest litigation filed by Maharashtra State Minority Commission Chairman Pyare Zia Khan be heard along with a pending case concerning the applicability of the RTE Act and Teacher Eligibility Test (TET) to minority educational institutions.
