The Bombay High Court’s Aurangabad bench overturned a 20-year-old conviction of a man and his family for alleged cruelty, finding the accusations didn’t meet the threshold for “severe” cruelty under Section 498A of the IPC.
The Aurangabad bench of the Bombay High Court has acquitted a man, his parents, and his brother in a 20-year-old case involving allegations of cruelty toward his deceased wife. The family had initially been convicted under IPC Sections 498A and 306 for cruelty and abetment to suicide based on accusations of controlling behavior, such as restricting her TV access, preventing temple visits alone, and requiring her to sleep on a carpet. However, Justice Abhay S Waghwase ruled that these domestic issues did not meet the “severe” cruelty standard. He also noted that allegations of forcing her to fetch water at night were contextually typical, as local water supply occurred at midnight.
