New Delhi [India], July 17 (ANI): The Kerala Waqf Board has moved the Supreme Court against a Kerala High Court order which has restrained it from taking any major decisions until issued regarding alleged violations of the Waqf (Amendment) Act over its composition are resolved.
A bench led by the Chief Justice of India Surya Kant and comprising of Justices Joymalya Bagchi and V. Mohana agreed to list the matter on Monday next week.

Today, the petitioner State Waqf Boards' counsel mentioned the plea and informed the Court that the HC order restraining it from taking any major decisions has made it practically defunct.
The Kerala HC on July 15 issued interim directions restricting the State Waqf Boards from taking any major policy decisions after noting that there were irregularities in its composition as per the Waqf (Amendment) Act. Allegedly, the Board violated the requirement of having two non-Muslim members in its composition.

The High Courts' direction had come on a batch of PIL petitions including a plea filed by BJP leader Shone George. Among other restrictions, the High Court had also directed the Board not to take any decisions that involve incurring capital expenditure without the Court's permission.
The case is listed to be heard by the Supreme Court on Monday. (ANI)
