New Delhi [India], August 26 (ANI): The unauthorised construction of shops in a temple in Karol Bagh area has been stopped after the Delhi High Court called for a report from MCD. The Civic agency informed the court that unauthorised construction has been stopped.
After Noting the submissions and considering the status report filed by the MCD, Delhi High court disposed of the petition moved by Advocate Kunal Khatumaria.
Justice Purushaindra Kumar Kaurav said that, in view of the aforesaid, the Court is satisfied that no further directions are required to be passed. The respondent-Corporation hasalready taken necessary steps to ensure that the further construction is stopped.
" The respondent-Corporation is bound by the stand taken in the status report," Justice Kaurav said in the order passed on August 21.
MCD filed a status report and stated that the property at Shiv Mandir Block No. 6, Dev Nagar, Karol Bagh, New Delhi had been inspected by the area Junior Engineer (Bldg.) alongwith the petitioner and his counsel on February 8, 2024. The property comprises only ground floor. Deities are installed in the premises.
" However, construction in the shape of kiosks without shutters had been found to be in progress at the premises. The construction had been stopped. The Mandir Prabandhak had been requested to remove the said construction," the status report said.
The SHO, P.S. Prasad Nagar, New Delhi, requested on February 7, 2024, that the MCD stop the construction and remove the workmen to avoid any further unauthorized construction at the site. The site has been re-inspected by the area Junior engineer (Bldg.) on16.02.2024. No further construction has been seen, it added.
The petitioner had alleged unauthorised/illegal construction on theland of Shiv Mandir Ratia Wali Piyaau, by Delhi Prantiya Raigar Mandir Prabandhak Committee.
It was contended that the land of the aforesaid temple has been converted into a commercial complex by Delhi Prantiya Raigar MandirPrabandhak Committee.
On February 5, Delhi High Court issued notice to the MCD and directed to inspect the site. It was also directed to file a status report in two weeks. (ANI)
