According to the complainant, the accused, Girish Ngonda Patil, entered the premises, engaged in a heated argument, tore office documents, grabbed her right shoulder, pressed it, and shoved her away—an act she stated caused her embarrassment and shame. Legal Distinction Between Section 354 and 354A
Upon reviewing the case material, the court noted that while the act involved physical aggression aimed at obstructing a public servant from performing her official duties, it lacked the essential elements required to invoke sexual harassment charges. Justice Mantri observed that Section 354A of the Indian Penal Code (IPC) specifically addresses acts involving unwelcome physical contact with explicit sexual overtures, demands for sexual favours, or sexually colored remarks. Because the incident stemmed from an administrative quarrel rather than sexual intent, the Bench determined that the charge under Section 354A (sexual harassment) was not applicable.
Retention of Charges and Quashing of Criminal Intimidation
While dropping the sexual harassment charge, the High Court clarified that the allegations still merit trial under other provisions of the erstwhile IPC. The court retained charges under Section 323 (voluntarily causing simple hurt), Section 353 (assault or criminal force to deter a public servant from discharge of duty), and Section 354 (assault or criminal force to woman with intent to outrage her modesty). Additionally, the Bench noted a lack of requisite mens rea (guilty intent) for criminal intimidation, opting to quash that charge as well.
