Nestle India Faces FSSAI Cases Over NAN Excella Pro, Lactogen Pro Claims and Biotin Test Failure

The Food Safety and Standards Authority of India (FSSAI) has initiated three separate adjudication cases against Nestle India over alleged regulatory non-compliance involving three infant nutrition products. The action concerns promotional claims made for NAN Excella Pro Stage 1 and Lactogen Pro 1, as well as a follow-up formula sample that failed to meet the prescribed biotin requirement in two rounds of laboratory testing.

Nestle India, however, has said its products are fully compliant with applicable regulations. The company said the labels of NAN Excella Pro and Lactogen Pro had been approved by an FSSAI expert committee and that the claims cited by the regulator are factual and supported by scientific literature. FSSAI Flags Promotional Claims on NAN Excella Pro

According to FSSAI, it examined infant nutrition products and promotional material available on e-commerce platforms as part of its proceedings.

For NAN Excella Pro Stage 1, the regulator flagged claims relating to “5 HMOs” and “Whey Protein”. FSSAI said it sought clarification from Nestle India regarding the claims before determining that the product was in contravention of Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020. The regulation restricts promotional claims and material intended to increase the saleability of infant foods.

Lactogen Pro 1 Claim Also Under Scrutiny

FSSAI separately raised concerns over promotional material for Lactogen Pro 1. The regulator flagged a claim describing its whey protein as “easy to digest”. According to FSSAI, the product was also found to be in contravention of the infant nutrition regulations. The authority also cited Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods (Regulation of Production, Supply and Distribution) Act, 1992, which restricts the advertisement and promotion of infant milk substitutes and certain infant foods.

Follow-Up Formula Fails Biotin Requirement

The third case relates to a separate nutritional compliance issue. FSSAI said a sample of a follow-up formula manufactured by Nestle India was found to be sub-standard with respect to its biotin content during laboratory analysis. The sample was subsequently sent for re-analysis. The Referral Laboratory also found it to be non-conforming with the prescribed biotin requirement under the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020. Nestle India Says Products Comply With Regulations

Responding to the action, Nestle India said its products are fully compliant with applicable regulations. The company said NAN Excella Pro and Lactogen Pro, along with their labels, had been approved by the expert committee of FSSAI. It added that it had submitted a detailed response to the authorities regarding the statements appearing on the labels. Nestle said the statements were factual in nature and supported by scientific literature. The company also said it would continue to cooperate with FSSAI and support its consumer-awareness efforts.

Three Separate Adjudication Cases Filed

FSSAI said three separate adjudication cases have been filed against Nestle India in connection with the three products. Two cases concern promotional claims associated with NAN Excella Pro Stage 1 and Lactogen Pro 1, while the third concerns the laboratory finding related to biotin content in the follow-up formula. The initiation of adjudication proceedings does not by itself amount to a final finding of liability or a product ban. The cases will proceed through the relevant regulatory process.

Nestle India Shares React to FSSAI Action

The regulatory action also weighed on Nestle India's stock during Friday's trading session. The company's shares fell nearly 3% at one point before recovering some of the losses, according to market reports. The development comes as Indian food regulators continue to increase scrutiny of food products, their labelling and promotional claims, particularly in categories subject to specific regulatory requirements.
