New Delhi, September 27: The Supreme Court on Thursday declined the plea to refer the Ismail Farooqui judgement to the larger bench and said the matter will be listed for hearing on October 29 before a three-judge bench. The top Court today pronounced its verdict on a batch of pleas by Muslim groups on the Ram Janmabhoomi-Babri Masjid title dispute seeking reconsideration by a larger bench. The Court, in a majority verdict of 2:1,  refused to refer to a 5-judge bench for reconsideration the remarks made as part of the 1994 judgement that 'mosque is not integral to Islam'.Catch LIVE updates on Ayodhya Verdict.

The case was heard by a three-judge bench, comprising CJI Dipak Misra, Justice Ashok Bhushan and Justice SA Nazeer. The Court delivered two separate opinions. Justice Ashok Bhushan has written for himself and for CJI Dipak Misra while Justice Nazeer penned his own opinion.

The bench observed that a place of particular significance for practising religion has a different place in law, the bench has observed. Issues, in this case, are entirely different from Faruqui's case doesn't decide any matter involved in these suits. Justice Bhushan, who read out the judgement for himself and the CJI, said it has to find out the context in which the five-judge had delivered the 1994 judgement. He added saying that law isn't always logical and each judgment is in context of its known facts. In a separate opinion on the matter, Justice Abdul Nazeer disagreed with CJI Misra and Justice Bhushan and said what is essential to religion as laid down in Ismail Faruqui was arrived at without comprehensive examination, needs to be re-examined in detail. He said questionable observations in Ismail Faruqui have permeated the Allahabad High Court verdict. He said whether the mosque is integral to Islam to be decided considering belief of religion, requires detailed consideration.
