The Madhya Pradesh High Court has ruled in favour of a 19-year-old married woman's right to reside with the partner of her choice, dismissing a habeas corpus petition filed by her 40-year-old husband. A division bench of Justice Anand Pathak and Justice Pushpendra Yadav held that the woman was not under illegal confinement and prioritised her personal liberty after she alleged ill-treatment by her spouse.

In a move to ensure her long-term welfare, the court also appointed two female mentors, termed "Shaurya Didis," to monitor her well-being for the next six months. IPC Section 377: Oral, An*l S*x Between Married Couple Do Not Constitute ‘Unnatural Offence’, Madhya Pradesh High Court Rules.

Background of the Case

The legal proceedings began when the petitioner, the woman’s husband, moved the court alleging that his wife was being held in illegal detention by another man (Respondent No. 4). Following court orders, the woman was produced before the bench from a "One-Stop Centre". During a direct interaction with the judges, the woman categorically denied being kidnapped or confined. She expressed a strong unwillingness to return to her husband, citing his age and alleged past ill-treatment during their marriage. Furthermore, she declined to live with her parents, stating they were not her well-wishers, and expressed a firm desire to live with her partner, Anuj.

The Role of ‘Shaurya Didis’

To safeguard the woman's interests as she transitions into a new living arrangement, the court invoked the "Shaurya Didi" concept. This initiative, previously detailed by Justice Anand Pathak in the Harchand Gurjar case (2024), involves appointing female mentors - typically police officers or social welfare staff- to guide and protect vulnerable individuals. The court appointed Anjali Gyanani (Government Advocate) and Lady Constable Bhavna as Shaurya Didis for the next six months. Their role includes:

The bench also questioned Respondent No. 4 regarding his intentions. He informed the court of their deep emotional bond and stated his intent to live with her in a "matrimonial fold" once she secures a legal divorce from her husband. He further undertook to ensure she would not face any harassment or embarrassment. The High Court concluded that no case of illegal confinement was established, as the woman is a major capable of making her own decisions. "Resultantly, the corpus is permitted to move with Anuj," the order stated, effectively disposing of the husband's petition.
