Bay Club in El Segundo Sued After Toddler Sustains Brain Injury in Fall; Disturbing Video Surfaces
Parents are suing The Bay Club in California's El Segundo after their 23-month-old son suffered a traumatic brain injury in a 2025 fall. The lawsuit alleges a staff member dropped the child from six feet, then provided false details to downplay the incident. The complaint also claims the facility operated without a required state daycare license. The club has declined to comment on the litigation.
A Los Angeles family has filed a lawsuit against The Bay Club in El Segundo, California, alleging that their 23-month-old son suffered a traumatic brain injury after being dropped by an employee at the club’s childcare facility. The legal action follows an incident on March 17, 2025, which the family claims was misrepresented by the facility’s staff.
Details of the Incident
According to the lawsuit filed by Rosen Saba, LLP, the toddler was in the care of a childcare worker at the club when she allegedly swung the child between her legs, hoisted him into the air over her head, and subsequently released his hands. The complaint alleges that the child fell approximately six feet, striking his head on the hardwood floor before the staff member fell on top of him. Security camera footage obtained by the family’s attorneys reportedly contradicts initial accounts provided by the facility.
Allegations of Misleading Information
The family claims that after the incident, staff members contacted the child's father to inform him that the boy had fallen but had "since calmed down", downplaying the severity of the situation. When the mother later spoke to an employee, she was reportedly told that the child had been held only 1.5 feet off the ground when the employee "fell over while in a squatting position". The lawsuit characterises this description as an "intentionally false and misleading" account designed to minimise the facility's liability.
Medical Impact and Legal Claims
Upon picking up their son, the parents observed significant swelling and bruising on the child's face, alongside signs of extreme lethargy and irritability. An emergency room visit confirmed the toddler had sustained a traumatic brain injury and suffered hearing loss. The lawsuit alleges negligence, battery, fraud, and emotional distress. Additionally, the complaint claims that the club was operating its childcare center without a required California daycare license while improperly declaring an exemption. In a statement regarding the ongoing litigation, a spokesperson for The Bay Club said, "We are unable to comment on ongoing litigation. At the Bay Club, the safety of our members, team members, and the families we serve is our highest priority." The California Department of Social Services noted in response to inquiries that it could not locate a license or record of an unlicensed facility at the location.
