According to court documents and evidence presented during the trial, the crimes took place while Bywater and his 29-year-old wife, Anika, were residing in the state of Veracruz, Mexico, reports the US Department of Justice. Law enforcement officials uncovered the operation after identifying the illicit material circulating on the internet. Investigators found that Alekzander Bywater had uploaded the videos to a publicly accessible website to sell them. On February 6 and 7, 2024, an undercover Federal Bureau of Investigation (FBI) agent in the District of Maryland successfully purchased and downloaded the recordings. Subsequent searches of electronic devices seized from the defendants yielded additional abusive recordings of the victim, alongside thousands of other unauthorised images and videos depicting the exploitation of children.

"Mr. Bywater’s depraved actions cost him his freedom, so now he’ll be separated from society where he can’t harm other children,” stated U.S. Attorney Kelly O. Alekzander Bywater faces a statutory maximum penalty of up to 150 years in federal prison. A sentencing date will be scheduled by a federal district judge following the completion of pre-sentencing reports. His co-defendant and wife, Anika Bywater, previously pleaded guilty to related charges and was sentenced in March 2026 to 25 years in prison, followed by 20 years of supervised release. The case was investigated by the FBI’s Child Exploitation Operational Unit, with support from the FBI attaché office in Mexico City and the Washington Field Office.
The prosecution forms part of Project Safe Childhood, a nationwide Department of Justice initiative launched in 2006 to coordinate federal, state, and local resources in tracking down offenders and rescuing victims of child exploitation.
