Chennai, August 21: A woman who had lodged a false case against her estranged husband for sexually assaulting their 11-year-old daughter now faces imprisonment under the Protection of Children from Sexual Offences (POCSO) Act. According to a Times of India report, if the woman is found guilty, she could be jailed for up to six months and also made to pay a heavy fine. Kolkata Man Gets Life-Term Within 5 Days of Filing of FIR For Raping Minor Girl, Fastest Conviction Under POCSO Act So Far.

In 2018, the man had approached High Court seeking anticipatory bail, in connection with the complaint by his estranged wife. His wife had falsely accused him by saying that he raped his 11-year-old daughter and made him pregnant. Then ayurvedic methods were adopted to terminate the baby. Shocked by the nature of the complaint, Justice Venkatesh held an inquiry and found the case to be false.

The judge at the Madras High Court said that this should a lesson for all those who attempt to misuse the provisions of the POCSO Act and use it to satisfy their own selfish ends. In Kolkata earlier this month, a city court sentenced a 32-year-old man to life imprisonment for raping a 17-year-old girl, within file days of filing the FIR. This was considered to be one of the fastest convictions under the POCSO Act.
