Punjab and Haryana High Court Says Wife Lodging FIR Against Husband Leading to His Conviction Is ‘Mental Cruelty’, Dissolves Couple’s Marriage on Man’s Plea
The court made the observations while hearing a plea by the man to dissolve his marriage on the ground of cruelty and desertion.
The Punjab and Haryana High Court recently said that a wife's action of lodging FIR against her husband in which he is convicted amounts to mental cruelty inflicted on him. Thus, the high court dissolved the couple's marriage while hearing the convicted husband's plea. The court also stated that the wife does not deserve any alimony. "The harm which is caused by her to the appellant/husband by lodging the FIR which led to his conviction leaves a stigma of being convicted on the appellant/husband which amounts to mental cruelty," the court observed. The court made the observations while hearing a plea by the man to dissolve his marriage on the ground of cruelty and desertion. In his plea, the petitioner-husband told the court that he and his wife were living separately for the past 19 years. He also informed the court that it would not be possible for him to stay with his wife due to his conviction in the cruelty case.
