Former Delhi minister and Aam Aadmi Party (AAP) leader Satyendar Jain has been arrested by the Anti-Corruption Branch (ACB) along with five others in connection with alleged irregularities and manipulation in tenders related to sewage treatment plants (STPs) of the Delhi Jal Board (DJB).
The case concerns alleged manipulation of tender conditions, restrictive technical specifications and a suspected financial nexus between private entities and public officials. The ACB has alleged that the tender process favoured Euroteck Environment Pvt Ltd and has also claimed that INR 1.52 crore was received as bribe by former DJB CEO Udit Prakash Rai through intermediary entities. Satyendar Jain Arrested: What Is Delhi Jal Board STP Tender Case and Who Are The 6 Accused?
Besides Satyendar Jain, the ACB has booked Udit Prakash Rai, former CEO of the Delhi Jal Board; Ankit Srivastava, a former contractual consultant with the DJB; Nagendra Yadav, proprietor of A.N. Enterprises; Raja Kumar Kurra, owner of Euroteck Environment Pvt Ltd; and Pankaj Verma, proprietor of Srijanhar.
The case was registered following a complaint by the Directorate of Vigilance over alleged large-scale irregularities, manipulation of tender conditions and criminal conspiracy in the tendering process for augmentation and upgradation of STPs operated by the Delhi Jal Board.
The accused have been booked under Sections 7, 7A, 9 and 13 of the Prevention of Corruption Act, 1988, as amended in 2018, along with Sections 420, 409, 418 and 120-B of the Indian Penal Code, the ACB said.
What Are The Allegations In The Delhi Jal Board STP Case?
According to the ACB, its investigation found that the tendering process allegedly contained restrictive technical specifications and conditions favouring a particular technology provider, Euroteck Environment Pvt Ltd.
The agency alleged that the conditions restricted competition and gave an undue advantage to the selected private entity.
The investigation also found alleged irregularities involving the non-conduct of a proposed pilot study, restrictive conditions concerning the technology or media to be used, the exclusion of essential parameters for treated effluent and subsequent changes to technical specifications.
The ACB said these alleged changes had significant financial implications for the government exchequer.
How Were Tender Conditions Allegedly Manipulated?
The ACB said its analysis of electronic evidence allegedly showed communication between private individuals, public servants and intermediaries concerning tender conditions, corrigendums and other documents linked to the STP projects.
According to the agency, several of these conditions and documents were subsequently incorporated into the tender notice issued by the Delhi Jal Board.
The investigation, it said, indicates an alleged nexus between private parties and public functionaries aimed at influencing tender conditions in favour of a particular technology provider.
What Is The INR 1.52 Crore Bribe Allegation?
The ACB has alleged that commissions or bribes were routed through intermediary entities, including Srijanhar and A.N. Enterprises. According to the agency, its financial investigation found that substantial amounts were transferred to the proprietorship concern of accused Nagendra Yadav from entities allegedly linked to Euroteck, the technology provider.
The agency further alleged that money was subsequently transferred to the bank accounts of former DJB CEO Udit Prakash Rai and his relatives.
“The investigation also revealed that Sh. Udit Prakash Rai, the then CEO of DJB, received bribe amount to the tune of INR . 1.52 Crores in his and his relatives bank accounts through banking channels from M/s A.N. Enterprises," the ACB said in its statement.
The agency alleged that the amount was subsequently used to purchase immovable property. It added that the funds transferred through A.N. Enterprises originated from Euroteck, the technology provider. The ACB said it was continuing to examine the complete money trail and alleged proceeds of crime.
What Did The Electronic Evidence Show?
The investigation has also uncovered alleged communications between Raja Kumar Kurra, Nagendra Yadav and Ankit Srivastava concerning meetings, tender conditions, corrigendums and other matters related to the STP tender, according to the ACB. The agency alleged that certain restrictive conditions were introduced or modified in a manner that favoured Euroteck Environment Pvt Ltd.
The arrests mark a significant development in the ACB's investigation into alleged corruption and irregularities in the Delhi Jal Board's STP tendering process.
The agency is continuing to examine the alleged money trail, electronic communications and the role of the accused in the tender process. The allegations remain part of an ongoing investigation, and the accused are entitled to due process under law.
