Madras High Court Refuses to Handover Minor Boy's Custody to His Biological Mother While Considering Child Never Lived with Her
The high court bench of Justice MS Ramesh and Justice Sunder Mohan said that the child had never lived with his biological mother, who was infected with HIV. The court also noted that the boy was handed over to a private respondent when he was born.
The Madras High Court recently refused to hand over the custody of a 3-year-old boy to his biological mother, considering the child's welfare. The high court bench of Justice MS Ramesh and Justice Sunder Mohan said that the child had never lived with his biological mother, who was infected with HIV. The court also noted that the boy was handed over to a private respondent when he was born.
