In his reasoned order, Additional Sessions Judge K.G. Joshi of the Nashik Road court invoked the cultural reference of Lord Krishna's birth in captivity to highlight the psychological distress and social stigma attached to delivering a child behind bars. The applicant, Nida Khan, who was arrested nearly two months ago, is currently five months pregnant.

"The trauma of giving birth in a prison like Lord Krishna or the related social stigma is not bearable for anyone," the court stated in its order. Judge Joshi added that exercising judicial discretion in favor of Khan was necessary to avoid an "agonizing situation" and to ensure the overall welfare of her unborn child. The court further noted that extending Khan’s detention served no logical purpose, given that the police investigation against her is complete and the formal charge sheet has already been filed. Khan was granted bail upon executing a personal bond of ₹75,000 along with a solvent surety of the same amount. Her defense counsel, Rahul Kasliwal, argued that Khan is highly educated, innocent, and had been falsely implicated in the case. She previously worked as an Associate at TCS before her employment was terminated in April 2026 following the allegations.

Despite granting bail on humanitarian grounds, the court emphasized that the prosecution's case against Khan contains explicit allegations. According to the investigation, Khan and her co-accused, Danish Shaikh, allegedly attempted to "brainwash" a female colleague, manipulate her ideological views, and coerce her into changing her religion.

The prosecution, opposing the bail, contended that the victim-a Dalit woman-was subjected to intentional s*xual exploitation and religious pressure. Investigators alleged that Khan played an active role by providing the victim with a burqa and Islamic religious literature, while claiming that "objectionable stories" existed within Hinduism. The case is part of a broader investigation by a Special Investigation Team (SIT) of the Nashik Police, which is probing nine separate complaints regarding the harassment, molestation, and forced conversion of female employees at the Nashik TCS unit. The specific FIR involves charges under the Bharatiya Nyaya Sanhita (BNS) for s*xual exploitation through deceitful means, s*xual harassment, outraging religious feelings, and provisions of the SC/ST (Prevention of Atrocities) Act.

Following the initial controversy, TCS management reiterated its zero-tolerance policy toward any form of workplace harassment and confirmed that the employees implicated in the case have been suspended.
