Justice Sugato Majumdar, a single judge, set aside the man's conviction under Section 498A of the IPC for abusing his wife both mentally and physically.
The Calcutta High Court's Jalpaiguri bench recently ruled that a husband and wife's regular arguments would not fall under the definition of cruelty as it is used in Section 498A of the Indian Penal Code (IPC). As a result, Justice Sugato Majumdar, a single judge, set aside the man's conviction under Section 498A of the IPC for abusing his wife both mentally and physically. But it affirmed his conviction and the Rs 1,000 fine that he was given under Section 323 of the IPC. ‘Physical Relationship Was Consensual’: Calcutta High Court Quashes Rape Case.
