The Allahabad High Court recently held that when a husband chooses to live away from his parents, mere failure in taking care of his parents does not amount to cruelty. The court observed while hearing the appellant-husband's plea who approached the High Court against the rejection of the divorce petition by the Principal Judge of the Family Court, Moradabad. It is reported that the man had filed for divorce alleging cruelty by the respondent wife as she was not taking care of his parents. The state's top court said that the appellant had himself chosen to live separately from his parents and wanted his wife to live with them to take care of them. The court also held that the alleged failure on the part of the wife in taking care of her in-laws is subjective in nature.
