'We Find That the Imposition of Death Penalty Would Be Unjustified', Says Supreme Court While Commuting Death Penalty of Man Who Raped Minor Daughter and Killed His Wife and 4 Children
The accused identified as Reji Kumar was convicted for raping his minor daughter and killing his wife and four children. The Supreme Court commuted Kumar's death penalty and said that although the offence is brutal, it did not justify capital punishment in light of his reformative conduct during incarceration.
On Tuesday, April 22, the Supreme Court commuted the death sentence of a man named Reji Kumar who has been convicted for raping his minor daughter and killing his wife and four children. The Supreme Court bench of Justices Vikram Nath, Sanjay Karol and Sandeep Mehta said that although the offence is brutal, it did not justify capital punishment in light of his reformative conduct during incarceration. The bench further stated that the sentence of death could not be sustained considering the convict's satisfactory jail record, past trauma and mental health concerns. "Considering the facts that the convict-appellant had no prior antecedents; good conduct for the past 16–17 years of incarceration; difficulties in mental health and consistent efforts at being a model prisoner, we find that the imposition of death penalty would be unjustified," the Supreme Court said.
