According to a division bench of Justices Suresh Kumar Kait and Neena Bansal Krishna, the husband may have found his peace by living with another woman but this cannot prevent him from getting a divorce from his wife after such a long separation.
The Delhi High Court has ruled that where there is no chance of reconciliation, a husband living with another woman for a prolonged period of time after separating from his wife is not cruel. According to a division bench of Justices Suresh Kumar Kait and Neena Bansal Krishna, the husband may have found his peace by living with another woman but this cannot prevent him from getting a divorce from his wife after such a long separation with little chance of reconciliation. It was also stated that the respondent-husband, wife, and kids would all be responsible for the consequences of such a relationship. Married Woman Living with Another Person Without a Divorce Not Entitled to Protection, Says Allahabad High Court.
