The Madhya Pradesh High Court recently observed that an accused's act of putting his hand on the victim's shoulder and allegedly pulling her clothes signifies his sexual instinct. The High Court bench of Justice Prem Narayan Singh made the observation while upholding the conviction of an accused identified as Nageshwar under Section 354 of the Indian Penal Code and Section 7/8 of the POCSO Act. As per the case details, the accused caught the victim, a minor girl's hand and reportedly pulled her clothes while she was returning from her relative's home.
